These Terms govern your use of ELH Coach ("Service"), provided by ELH Empire LLC ("we", "us"). By creating an account or using the Service you agree to these Terms.
ELH Coach is a multi-tenant platform. Each "tenant" is a workspace owned by you (or your business). You are responsible for the security of your account credentials and all activity within your tenant, including any users (coaches, admins, clients) you invite.
Your clients' health information may include data classified as Protected Health Information (PHI). You represent that you have the legal right to collect and process this data, and you agree to use the Service only in compliance with applicable laws (HIPAA, GDPR, CCPA, state biometric laws, etc.).
HIPAA Business Associate Agreements (BAAs) are available with the Real Domain Upgrade only. Without a BAA, do not enter PHI into the Service.
You agree not to: (a) use the Service for unlawful or harmful purposes, (b) attempt to access another tenant's data, (c) reverse-engineer the Service except as permitted by law, (d) sell, sublicense, or white-label the Service outside the Real Domain Upgrade, (e) use the Service to provide medical diagnoses or to replace licensed medical advice, (f) send unsolicited messages to clients who have not opted in.
You retain all ownership of the data you and your clients put into the Service. We retain all rights in the Service itself. We grant you a non-exclusive, non-transferable license to use the Service for the duration of your subscription.
The Service is provided "as is" without warranty. To the maximum extent permitted by law, our total liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim.
The Service is not a medical device. It does not diagnose, treat, cure, or prevent any disease. Always consult a licensed healthcare provider for medical decisions.
You may cancel anytime from the billing portal. We may suspend or terminate your account for material breach of these Terms with reasonable notice (or immediately for serious violations like security threats or fraud).
Upon termination, you have 30 days to export your data via JSON/CSV. After 30 days, we may delete your tenant data permanently.
We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect.
